APPLICATION AND AGREEMENT FOR TEMPORARY USE OF “BIG HOUSE,COZY CABIN & THE FARM” PROPERTY
Red River Gorge Retreats Inc leases the property described at big house,cozy cabin & the farm property and shown generally in the satellite photos below. You have expressed a desire to use this property for the purposes set forth below. In making this application and agreement you understand and acknowledge that you have read and understand the terms and conditions on the back of this document and you agreed to be bound by these without limitation and agree that the terms and conditions are an integrated part of this document.

Cancellations can be made by phone or email and there is also an option to switch your event to another unreserved date at no extra cost.
10% fee if cancelled reservation is more than 90 days in advance
50% fee if cancelled reservation is 31 to 90 days in advance
100% fee if cancelled reservations is less than 31 days in advance

TERMS AND CONDITIONS
This Agreement is solely for the use of the land for the purposes set forth herein. I understand and agree that the Venturas will provide no facilities or equipment. 2
.The maximum number of cars that may be parked on the property is ___________________.

You may enter the property at 3:00 p.m. on the first date above and you must be off the property by 11:00 a.m. on the last date above.If more time is required you must first ask Susan or Miguel .
You are responsible for all of the actions and activities of your party and any and all people in attendance, including minors.
You are not entitled to exclusive use of the entire property. The Venturas may enter the property for any reason including monitoring the use of the property. If the Venturas or their agents believe that any person is behaving in a dangerous or irresponsible manner they may immediately remove that person from the property.
7.The following actions are strictly prohibited:
A.No person may come within fifty (30) feet of the back of the property where there is a dangerous cliff line. This is clearly identified on the attached satellite photo below. There are also signage marking the boundry lines.You are solely responsible for ensuring that no one violates this condition. Violation of this condition may result in the immediate halting of your function without recourse.
B.Littering is prohibited. You are solely responsible for all clean up. Please carry out and dispose of everything that has been brought in.
C.Cutting or removing any vegetation or trees is prohibited.
D.Parking is limited to the designated areas only. You are responsible for all damage to the property resulting from the use of motor vehicles.
E.No illegal drugs or illegal activities are permitted on the property.
F.No swimming in the pond is allowed on the premises.
8.You acknowledge and understand that you must inform Susan or Miguel Ventura of any additional wedding plans you have planned 1 month ahead of the wedding that are above and beyond a typical basic wedding ceremony such as fireworks, bringing in of horses, wagons, furniture, any cooking appliances ,any entertainment equipment etc.
9.You acknowledge and understand that you must provide a certificate of additional insured insurance form(s) from every hired service you plan on bringing onto the property.This form must list red river gorge retreats inc at address1890 Natural Bridge Road Slade Ky 40376 on this form as the named additional insured as well as provide their insurance policy data. This included any services that are prepared elsewhere and then brought in like a catering service for example.
10. You acknowledge and understand that this property is in a dry county and that you take full responsibility for any alcohol that you or your guests bring onto the premises.
11.You acknowledge and understand that it is your responsibility to stack the tables and chairs after your event in the fashion that Susan or Miguel ask and to gather all the cloth tablecloths provided and put them together in a plastic bag.
12. On behalf of yourself and any and all guests or others that are on the property in connection with the wedding, any and all family members, heirs, representatives, executors, administrators, and you yourselves do hereby fully release and discharge the Venturas and their employees, agents, and family members from any and all claims, causes of action, demands, and complaints of any kind whatsoever, that you may now have or may have in the future against the Venturas and their employees, agents, and family members on account of any personal injury, damage, loss of consortium, property damage, accident, or death arising out of or in any way relating to any person on the property in connection with your event.
13.The damage deposit will be returned to you within thirty (30) days after you vacate the property, provided the property is in as good a condition as it was when you took possession of it. If there is any damage to the property or any contents missing or excessive clean up is necessary then you agree that your damage deposit will not be returned
14.You promise and agree to indemnify, defend, and hold harmless Miguel and Susan Ventura, their employees, agents, and family members from any and all claims, causes of action, demands, complaints, losses, costs, attorneys fees, and expense arising out of or in any way relating to your or anyone acting for or on your behalf or for any other person on the land in connection with your use of the property
15.On behalf of yourself and any and all persons on the property in connection with your event, you agree that any action or dispute of any kind arising from the use of the property shall be submitted to binding arbitration to be conducted in accordance with the laws of the Commonwealth of Kentucky and at a location in Lexington, Kentucky.1
This Agreement shall be governed by the law of the Commonwealth of Kentucky and Kentucky.
If any part of this Agreement is found to be void or unenforceable, such finding shall not affect the force and binding nature of any other portion of this Agreement.
This Agreement is entire and complete and there are no prior agreements of any kind. Any change to this Agreement must be in writing.
